i would have thought an NDA + “here’s your free laptop, shut up”, out of court would have been far less risky for them.

They probably thought they’d win.
Surely their lawyers aren’t that stupid.
“Oh, hi, you sold this processor as supporting VM instructions that provide full security seperation between virtual machines. I bought it for this purpose. It is not fit for purpose.”
It’s entirely possible.
The EU courts are an interesting bunch. I’ve seen a lot of odd cases lately.
That’s probably the argument made to the judge.
