Unfortunately it is legal. The idiots in the FCC view it as "competitive" and I don't think carriers are classified as ISP's(could be wrong though).

This makes me sad in many ways...

Tmobile started this if I'm not mistaken over a year ago. Comcast is taking a page out of this book, by offering a video streaming service that doesn't count against your cap, due to it being considered " networked " and not internet... SMH !

I don't think you can nail them on grounds of net neutrality, but you can probably sue on grounds of monopoly laws or something.
