TN and NC sue the FCC

The state of North Carolina and Tennessee are suing the FCC over the FCC preempting state laws. I was alarmed to hear this because I live in the backwoods of North Carolina.

For those of you who don't know, the FCC preempted the laws because "the Tennessee and North Carolina laws are barriers to broadband infrastructure investment and that preemption will promote competition in the telecommunications market by removing statutory barriers to such competition."

Both cases are being heard by the U.S. Court of Appeals for the Sixth Circuit. The status of both cases are "case is not ready to be briefed"

Is it just me or does it sound like these laws are going to be stuck in purgatory?
