Word of warning, the language is going to be quite harsh. So if you have sesitive eyes to language, then don't read. I was honestly pissed with I found out.
This is why I exactly hate apple. They file patents that I find are stupid and useless, such as a wedge shaped laptop, WHICH THEY DID NOT INVENT! I say they DID NOT EVEN INVENT A DAMN THING! Some things they claim they invented all ready existed even before they thought of the ideas. Samsung USA I would suggest to stop selling parts to Apple to show them they need to stop. God I fucking hate the patent system. It gives a loophole for companies to sue other companies to ban sales of products, which really hurts the consumer by limiting the choices on the market. It also hurts the other company. I say the patent system needs to be overhauled for sure. That will help clean the market up all I have to say is FUCK APPLE! IDC WHAT FANBOYS SAY! APPLE IS NOTHING BUT A COMPANY SUING THE SHIT OUT OF OTHER COMPANIES TO GAIN COMPETITION! I can't fucking stress this enough. I'm waiting for apple to get landed with lawsuit after lawsuit. If Google wins, that means just about ALL apple products will be off the US Markets. Cause I don't find it fair as a consumer having just one choice of a product while shopping. Apple is just hurting the consumer market! I have nothing more to say!
I just realized something. This is one huge cycle with Apple. Microsoft and Apple have the same type of contract that AMD and Intel have. The only reason that people wont leave Apple in the dirt, and probably why Apple will continue to win in court, is because of this. "This" being the fact that if Apple dies as a company, Microsoft MONOPOLIZES. The government doesn't like that, so that is a preventive measure against that bout. But here's the kicker, Apple essentially "owns" the courtrooms from this little contract. The goverment is essentially telling everyone in the industry to "fuck off" in a more finanical way. Kill the other corperations whom feed Apple, so that way Apple can absorb said company and then grow from it.
In a nutshell, Apple is legally not allowed to die. But in this process that has been recurring, other companies are getting bought out by Apple, strengthening it. Samsung just took a big enough hit to be targeted for a buy-out. Motorolla is getting there too. Apple is strategically suing companies that benefit them soley to buy them out. This is all going to continue until a new party arises with a better product than both MS and Apple.
Lets say Sony gets into heavy software and OS development. They also have their own facilities to build their own equipment from scratch. They'd be, in theory, able to monopolize the industry if they wanted to. So with that said, what's everyone's thoughts?
I don't care much for Samsung's phones, and granted, a few of their older products do bear some resemblance to the iPhone, but this ruling is just crazy. I have no doubt Samsung is going to appeal in court, which will likely reduce the fine a bit, but still, when I found out I basically wanted to throw my iPad out of the window (it's a 2010 iPad, aka first gen, back then there were no decent android based alternatives available). Come October, it's getting replaced by a Nexus 7 or a Surface though (not available yet in mainland Europe).
My biggest fear though is that this case will set a precedent that Apple can just get away with sueing everybody and their dog and patent trolling away.
The thing that pissed me off the most about this is their press release, they said that apple is against stealing. WHAT THE FUCK? APPLES WHOLE COMPANY IS BASED OFF STEALING!!!!
This made me want to walk into apples offices and dropkick every senior employee and all of apples lawyers.
Buy out Samsung? I dont think so. Samsungs Electronics profits for last were about about 12 billion, in the US alone. The reward from the court is roughly 1/12 of that. Their parent company Samsung group neted 18 billion or so in 2011.
Plus you have to figure, they are well divisified. Samsung isnt just electronics makers they also dabble in heavy industries, insurance and a plethora of others and they do so in markets aside from the US. There isn't going to be a buy out anytime soon given current conditions.
If this turns out to be such a major problem for Samsung within the next 3 to 5 years and they lose significant market share in the tablet and smart phone space, maybe they will pull out of the U.S. market. That's a far flung prediction, I know, but right now it's too soon to tell what exactly is going to happen, aside from a buyout.
What we do know is that the courts are creating a mess and I hope there is a way to stop it. The real enemy isn't Apple it's patent law.
Apples balance sheet is off the hook as you can see, they could probably easily afford to buyout Samsung, if they wanted to, especially now Samsung share price is in free fall.
I've always hated apple since I heard of 'Tangerine' Mac's back in the 90's and they've got worse ever since. Never been tempted to buy an apple product and never will, the more I learn about this company the less I like it.
But it seems they are out to destroy the technology community and most especially OEM's and Modders first, using their army of low IQ sycophants. Stunts like Gluing components into any computing device shouldn't be legal, surely it breaches consumer rights legislation in many countries. How can any device be fit for sale when it has been rendered unrepairable. This is clearly an abuse of Anti-trust legislation in the US and Monopolies legislation in the UK and EU. All this litigation follows of abuse of the patent system by Apple which has led to them being almost a monopoly, huge payouts from tech illiterate juries will exacerbate this by putting competitors out of business or rendering them to afraid to innovate and release new products. Surely this is clearly conspiracy to create a monopoly and is covered by the 1890 Sherman Antitrust Act and most of the Antitrust legislation passed since. Secondly Apple is definitely acting in a manner to suppress competition, gluing in components stops 3rd party component manufactures from selling their wares and excessive litigation should be considered anti competitive behavior. It only takes one win to establish a case law precedent.
Perhaps US and Global Tech companies should abandon pursuing the rotten fruit via the broken and corrupt patent protection system and instead pursue the clear market monopoly position which Apple is abusing. Even Samsungs current legal team could surely prepare enough Anti trust evidence against apple in time.
That GIF , posted on this particular topic, made me spil my hot chocolate all over myself from laughing. My skin hurts. But it was worth it for that big of a laugh xD
Now now.. As the android/samsung fanboy I am, I think Samsung really messed up good in this case (referring to their huge document on how to specifically copy the iphone. If it hadn't been for that, they would have a pretty solid case).
Keep making good hardware, Samsung, I wont use your touchwiz anyways.
I just read an interview with the Jury foreman, this guy takes responsibility for how fast the decision was made and the course that the decision went.
From what I can tell even though he says he know how the system works, he has no clue!
Correct me if I am wrong but didn't Polroid win just under a billion from Kodak back in the late 80's early 90's and 10 years later Polaroid was broke? This is what this case reminds me off.
An American company against a Korean company in a silicon valley court. They didn't stand a chance.
Yet another reason not to but Apple. Never have and never will. Also will encourage others to follow suit.
Samsung might want to push for a mistrial based on Jury incompitency. It seems that the guy that people have been interviewing was a plant to control the outcome.
I've always considered myself an Apple fan.. and i have an iPad and Macbook Pro ever since this whole legal crap started I think my next product choice WON'T be apple.
I mean Apple will probably start sueing Google because the Nexus 7 looks too much like the stupid iPad mini.
