usually u can just get a ssd that has a tranfer kit or buy the transfer kit (usually a usb to sata cable) and then use a cloning program to clone the drives and then u just put the ssd in your system and all should be good

Yes that's correct. I bet someone here on the forum have done some more research on int than me, but the way i understand it is that the HDD and the SSD are fundamentally different in how the work and how they compile data, so that you are better served by doing a clean install on the SSD and just backup your files.
The OEM is locked to your mobo so you could download an illegal windows installation and install it with your serial key thus making it legal, if you then get problems with the autheticator you could call microsoft. Or get a hush hush windows unlocker xD(The way i see it, you have already paid for it)
