SO recently I purchased the game "Landmark". This is a game being developed and managed by SOE. I purchased the game through steam. I quite honestly hate the game and feel it was falsely advertised and I am willing to go ahead and prove it if need be.
Anyways I want a refund for my game but both Steam and SOE have been giving me conflicting reports. Here is what they have told me through online source. I will include what they told me over phone calls.

At no point have any of them linked or reference any actual policy with Steam or themselves to prove that they are not responsible for purchases made through Steam.
Steam told me that with any game issues in-game or not in-game that it's the Dev's responsibility to refund me or deal with my problems, Sony has since then gave me the opposite.
As far as I know Landmark is an Early Access Game (which is what it says before you purchase the game) so it's still being developed. On that note, You will rarely ever receive a refund if you have bought any software/game through Steam. And why would you? Are they going to just take your word that you haven't copied the legitimate CD KEY assigned to your game? Sell it elsewhere, or use it after they refund you?
Again, If you want a finished product, don't buy Early Access Beta Games.
yeah, but if he had bought the game from a regular bricks and mortar store he would have been able to return it, wouldn't he?
i mean, it's part of his statutory rights under law in the USA or UK or similar jurisdictions. i'm not a lawyer, but this seems fishy to me (either that or incompetence). i would say be persistent.
No, like usual you're never purchasing the actual software/game, just the license to use/play it. It's more like buying a World of Warcraft Subscription and then returning it after it's already been used.
Any open Games, DLC, Movies, etc can not be refunded anywhere. Not Game Stop, Best Buy, or any other Brick and Mortar Store. But they'll buy it back from you for $3.00 if you like?
I would be completely on your side on any other day of the week. I would push for refunds and removal of the game from you library.
But this is not every other day of the week. You bought an early access game. Most if not all developers clearly state that what you are getting is not finished and likely to be different than the final release, Steam have pointed out that Early Access titles do not follow regular rules, due to their unfinished nature.
You are also on PC and this is one of the points of modern gaming I cannot understand. Before you put down penny one, go look up game play, reviews, and in many cases the PCGamingWiki to see if it is broken right now. A lot of people don't do this and then get pissed off when what they bought is different from what they thought they were buying. I have zero sympathy in these cases.
Also on the false advertisement, you may have a point there but I never, not once trust a singe syllable from any Triple A developer/publishers mouth. I am cynical and untrusting of large companies, they want to make money and will screw every little guy they can to do it. Yeah it is a pain sometimes but I have a much better experience with everything I buy because of it.
I have bought into Early Access games and some have been wonderful and others have been less than good. I have never once wanted a refund from Steam because I did the above and I knew what I was getting into.
It is harsh, but it is EXACTLY what you signed up for.
So can anyone actually find any legal issues with this because they don't actually have any physical proof that they can't refund me. Don't they need to show me a terms of agreement or something in the like?
I have liked the game a ton, I actually paid $100 for the game prior to the release into steam. I have been playing since the first closed alpha. It is not a game for everyone. It will get there, but it is a 3d slimmed down version of terraria right now. Eventually you will be able to go so far as to script your own AI, and control forced camera angles for "cutscene" creation.
And, it is in the terms of service you already agreed to when you purchased the game.
Terms of agreement? You mean like EULA (End User License Agreement) and SSA (Steam Subscriber Agreement).
From the SSA:
3. BILLING, PAYMENT AND OTHER SUBSCRIPTIONS
ALL CHARGES INCURRED ON STEAM, AND ALL PURCHASES MADE WITH THE STEAM WALLET, ARE PAYABLE IN ADVANCE AND ARE NOT REFUNDABLE IN WHOLE OR IN PART, REGARDLESS OF THE PAYMENT METHOD, EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT.
IF YOU ARE AN EU SUBSCRIBER YOU HAVE THE RIGHT TO WITHDRAW FROM A PURCHASE TRANSACTION FOR DIGITAL CONTENT WITHOUT CHARGE AND WITHOUT GIVING ANY REASON UNTIL DELIVERY OF SUCH CONTENT HAS STARTED OR PERFORMANCE OF THE SERVICE HAS COMMENCED. YOU DO NOT HAVE A RIGHT TO WITHDRAW FROM A TRANSACTION OR OBTAIN A REFUND ONCE DELIVERY OF THE CONTENT HAS STARTED OR THE PERFORMANCE OF THE SERVICE HAS COMMENCED, AT WHICH POINT YOUR TRANSACTION IS FINAL. YOU AGREE THAT DELIVERY OF DIGITAL CONTENT, AND THE ASSOCIATED SUBSCRIPTION, AND/OR PERFORMANCE OF THE ASSOCIATED SERVICE, COMMENCES AT THE MOMENT THE DIGITAL CONTENT IS ADDED TO YOUR ACCOUNT OR INVENTORY OR OTHERWISE MADE ACCESSIBLE TO YOU FOR DOWNLOAD OR USE.
