Hey so know that 8.1 is out and they have added boot to desktop and I can get startback i'm thinking of making the switch. My question is since I am running 7 right now how do i go about installing 8.1. Will it swipe my hard drive and i have to start over again or can I keep all my files on my HDD?

You can keep your files on your hard drive, however I would honestly recommend that you just back up what you actually need to keep externally or on another internal drive, wipe the whole drive and start over completely fresh with 8. In my opinion this is always a better option.

So if I just keep the files, how do I go about installing it without losing stuff. Do I just pop in the new cd and it will go on and take 7 off while it installs?
Just doing that will upgrade Windows (if that can even be done from 7 to 8.1)
Ideally you want to shrink your current partition to as small as it can go, then create a partition in the new empty space, transfer all your important file to the new partition. Install windows 8.1, letting it wipe the original partition, copy all the data back, delete the temp partition and then expand the first. Simple....
