So, i have a slightly annoying problem.. In multiple games, so far Far Cry 4, Witcher 3, and Battlefield 4. I get a weird frame rate issue. In Ultra settings across all 3 games, it get a solid 60FPS, then it just divebombs to 30 and below and sometimes just stays there. When i switch it to low or mess with the graphical settings is literally does the exact same thing.. To the point its pretty annoying to play games. Ill list my rig specs below.
CPU: AMD FX-9370 (OC to 4.9)
GPU: XFX R9-280x Black Edition
Ram: 8GB Corsair Vengence
Mobo: Asrock 990FX Extreme 3
HDD: 3TB Toshiba
Heatsink: Asetek 570LXL Extreme Liquid CPU Cooler
OS: Windows 8.1
Any help would be amazing.. Im not expecting to play Witcher 3 at a perfect 60FPS with my build but atleast a stable 30..
Have you checked your drivers?

i did, they're all up to date.
Your motherboard's VRM is not beefy enough to handle that processor - it's not even on the supported CPU list. It has a 4+1 phase VRM, with a small heatsink. Your VRM is probably overheating and throttling your CPU.
If you downclock your CPU down to FX-8350 clockrates, you should probably be good.

the stock 4.0 or the slight 4.2 of the 8350?

Although it sucks that you're not using your processor to the "full potential," I wouldn't worry about it too much. Take a look at this review at Tom's Hardware; Beyond the 4.0ghz mark, there starts a steep case of diminishing returns. If you can manage 4.2ghz without throttling, I would say go for it. If you can run your CPU at 4.2ghz with 1.2V, you would have a fairly efficient rig.
If you stream gameplay, or encode videos and whatnot, and you want all the performance you can get from overclocking (or just like overclocking) you're going to need to spend at least $100 on either the MSI 970 Gaming, or the ASRock 970 Performance. These should be able to get you to 4.5ghz. Beyond that, you'll have to spend a bit more and go with the Gigabyte 990FXA-UD3, ASRock 990FX Extreme 6+, or the Asus M5A99FX-PRO.

sooo, the problem is back but now it even affect Gmod.. to the point it drops my Gmod to below 30 FPS.. any ideas on what it could be now? could it be a bad hard drive or possible because im using and HDTV instead of a monitor? or maybe even re-applying thermal paste to the CPU?
Check thermals and clock rates while under load. If they are operating as they should, then it is probably a software issue.
Ive ran a benchmark through Overdrive earlier. My average is about 40 c, which, maybe its just me but i feel like is hot for a liquid loop. But what i noticed to be weird is that at times during the benchmark it will shoot up to about 57 c then just plummet to back to about 38 c. But also i after reading the Fx-8350 article, i have its UC to 3.8ghz and uv to 1.287 through overdrive along with all throttling turned all through the bios. Also after running the benchmark, it just stayed at about 53c for awhile..
This is just a random thought but maybe a new coat of arctic silver might help?
Suprised you havent set fire to the Asrock 990FX Extreme 3 yet running a cheap crappy 4+1 VRM mobo with a 8 core 220wTDP cpu is a real bad idea, i suspect your chip is being strangled and throttled.
The FX 9370 is not supported on the 990FX Extreme3 and even asrock suggest using a top down blower because there vms are not worth a shit and over heat.

well looks like part tomorrows paycheck is going to a new mobo xD. what really baffles me is that, i would have thought CyberpowerPC would know what the hell they where doing before they offer a build >_>.. I guess thats what i get for being lazy.
A botched thermal compound application usually only amounts to a couple degrees difference in performance, so I wouldn't worry about re-applying thermal material. (Although, it won't hurt if you do.)
If your clockrates are going up and down along with your temperatures, you might be still experiencing throttling due to VRM overheating. 3.8ghz powered by 1.287v seems like a touch too much voltage, but you may just have gotten slightly unlucky with the silicon lottery.
Anyway, yeah, it's probably time to invest in a new motherboard. Keep us updated!
I'll try undervolting it a little more when I get home. Out of the motherboards you suggested what would be the best one?

The ASUS M5A99FX-PRO will have have the most feature-rich BIOS to let you eke the most out of your processor. The Gigabyte UD3 needs to be a Revision 4.0 or greater to handle those serious overclocks, both because of the heatsinks on the VRM, and for the UEFI BIOS. The ASRock Extreme6 is one of the later releases of the 990FX chipset, and was made to handle those 9000-series CPUs; I know ASRock has a pretty good BIOS, but I don't know what sort of features it has in terms of load line-calibration.

well i dont know how much money you have to spend?
Decent AM3+ 990FX mobo's in order to handle a FX8 core totaly high OC´s fine.
