This is a case I've been following for years.
Here is the TLDR version of the case. In 2007 a woman uploading a video of a baby dancing to a prince song that was playing the background. Video was taken down due to the DMCA. The EFF stepped in and agrued fair use. It went to the US Court of appeals:
The San Francisco-based U.S. Court of Appeals for the Ninth Circuit last year sided in part with Lenz, ruling that that copyright holders must consider fair use before sending a takedown notice. But the court also held that copyright holders should be held to a purely subjective standard. In other words, senders of false infringement notices could be excused so long as they subjectively believed that the material they targeted was infringing, no matter how unreasonable that belief.
Lenz is asking the Supreme Court to overrule that part of the Ninth Circuit’s decision to ensure that the DMCA provides the protections for fair use that Congress intended.
This case is pretty important. There should be some accountable for false copyright claims in my opionion. Now weather the US Supreme Court takes this case up to hear it or not remains to be seen. The worse part right now is the US Supreme Court only has eight judges which could result in a tie which means the lower court ruling stands. I'll continue to follow this case and see what happens with it.
