Does nvidia power mangagement complete neuter the full potential of anyone elses graphics card. If so is it done on purpose

Before anyone says turn it off I never turned it on some driver update made it so my personal setting I adjust in nvidia control panel don't stick. In every game aside from demanding and current titles my gpu usage has been stuck at 20% load max even in moments of getting frames low as 20 fps in some games the gpu refuses to work harder. I really want to know how big a this issue is. I have had the issue for about a month or 2 and since unreal tournament and hawken where the only games giving me issue I thought it was the games faults and not mine just to discover its the fault of nvidias. I just never noticed the issue till now when I looked at my gpu load and saw it was lower than ever in some games. I found several threads about this and how to fix it but never heard nvidia address it. Its almost like they want to keep the issue to upsale graphics cards the adaptive perfromance is that bad I further tested some games I no longer play and my 550 ti with adaptive power management mode turned off on another system out performs the performance my card was currently getting in a few games due to having its max potential drawn while my 760 continues to do jack shit.

Disabling the function doesnt change anything?
Also what are your other system specs?

Disabling it for me can make a huge difference for me. Like getting over 100 fps consistently in warframe and dirty bomb to dipping between 60-40 fps in those 2 games with it on.

I have a intel core i5 4440 and 8 gigs of ram.
